Rechazamos que Luis Almagro pretenda invocar la Carta Democrática en contra de Venezuela

Quienes suscribimos la presente comunicación, ciudadanos demócratas, amantes de la paz, activistas de los movimientos sociales, defensores por convicción, de los derechos humanos, acudimos por su intermedio, con todo respeto, al Consejo Permanente de la Organización de Estados Americanos para alertar a sus miembros acerca de la torva intención de intentar convencerles que en Venezuela existe una ruptura del hilo constitucional, una crisis humanitaria, o cualquier situación extrema que les induzca a aplicar indebidamente la Carta Democrática Interamericana y crear las condiciones que facilite cualquier intervención armada de Estados Unidos porque las medidas unilaterales coercitivas, prohibidas en el derecho internacional y en la Carta de esta Organización, ya las viene aplicando.

La mayoría de los Estados miembros de la Organización, representados en ese Consejo, tienen sedes diplomáticas en Venezuela, por lo tanto tienen pleno conocimiento que la pretensión de sancionar a nuestra patria no tiene ningún asidero. No hay engaño posible.

En Venezuela, desde hace 18 años el pueblo decidió construir su camino, desde la perspectiva de la democracia participativa, lo que nosotros denominamos, Revolución Bolivariana. En Venezuela hay plenas libertades fundamentales. Tenemos un gobierno que usa los recursos públicos para invertir en la gente y más aún, y por eso lo elegimos, para que seamos el centro de sus políticas públicas, y no del Dios Mercado, de manera que el pueblo se convierta en sujeto protagónico del hecho económico.

En Venezuela tenemos los problemas que padecen sus respectivos países, con la diferencia que tenemos enormes riquezas y además hemos tenido al Presidente Hugo Chávez con nosotros que enarboló las banderas del socialismo, de la soberanía, de la unión latinoamericana y caribeña, que levantó y practicó enérgicamente, la solidaridad internacional, reivindicando los sueños libertarios de Bolívar, el Libertador.

Paradójicamente, quienes desde Venezuela vienen apoyando las aspiraciones injerencistas contra nuestra patria son los que dieron un sangriento golpe de Estado en abril de 2002 y desde entonces, no han modificado su intolerante conducta y vienen conduciendo con sus agentes económicos y comerciales una brutal Guerra Económica contra el pueblo. Incluso, lo han hecho de manera tal, que la misma les ha producido grandes ganancias. Intentan desesperar a nuestra gente. Buscan una confrontación interna. No lo han logrado porque tenemos al Gobierno del Presidente Nicolás Maduro que ha sabido enfrentar, a pesar de la caída de los precios del petróleo, la guerra económica adoptando medidas puntuales que vienen garantizando el acceso de nuestro pueblo a los alimentos y medicinas. Además siguen funcionando, alcanzado sus metas, todas las Misiones y Grandes Misiones, que se constituyen en el centro de los programas sociales de la Revolución.

Los enemigos de nuestra democracia bolivariana, son enemigos del proceso de Diálogo Nacional en Venezuela porque necesitan mantener viva la crispación, excusa para asaltar el poder legítimo. Siguen en su obsesiva pretensión, a pesar que fueron derrotados limpiamente en su intento del 11 de abril de 2002. Fueron perdonados por el Presidente Hugo Chávez, y no cesan, desde entonces, de una u otra forma, en desconocer y violentar la voluntad del pueblo venezolano de continuar apoyando, con más firmeza que nunca, el proyecto político que privilegia la democracia participativa y protagónica, fundamento principalísimo del Estado democrático social de derecho y de justicia contenido en la Constitución de la República Bolivariana de Venezuela.

Así han venido actuando, sin ningún cambio, en forma suicida, intolerantes, violentos, irrespetuosos de la Constitución Bolivariana, teniendo incluso, lo que no habían logrado antes, es decir, la oportunidad de mostrarse como opción democrática, desde el Poder Legislativo. Pero no lo han hecho. Por el contrario arreciaron su furia. No entendieron el mensaje que el pueblo les dio.

Nos referimos a quienes habiendo obtenido suficiente apoyo electoral, para dirigir la Asamblea Nacional, presentaron sorprendentemente, el mismo día de su instalación, 5 de enero de 2016, un plan para derrocar al Presidente Constitucional de la República Bolivariana de Venezuela Nicolás Maduro, desdeñando que nuestra carta magna no le confiere al Poder Legislativo ninguna facultad en esa dirección contra el Jefe de Estado.

Intentaron crear confrontaciones entre los Poderes Públicos, pero nuestra Constitución fue redactada para mantener la estabilidad del Estado. Es tan errática e incongruente la conducta de la oposición antidemocrática, que luego de intentar decretar ilegalmente el abandono de cargo del Presidente de la República, le exige al primer mandatario que realice el Mensaje Anual a la Nación, desde ese Hemiciclo. No son confiables.

Lamentablemente, la Asamblea Nacional sigue en desacato por decisión de quienes la conducen y han sido invitados reiteradamente, a volver al camino constitucional.

Necesario también es abordar dos situaciones que la oposición viene utilizando indebidamente.

En el año 2016, por las importantes diferencias internas de los factores políticos que componen la oposición, no lograron ponerse de acuerdo para activar el Referendo Revocatorio en el tiempo que les fuera útil políticamente hablando, es decir, en la mitad del período presidencial como lo dispone la Constitución. Además de la activación tardía del mecanismo, presentaron firmas fraudulentas, ilegales, de menores de edad y personas fallecidas, que invalidó el largo proceso refrendario. Sin embargo, cuenta el hecho fundamental que de haberse efectuado y obtenido una hipotética victoria, se efectuaría en el 2017, cuando no era posible que estos llegasen a Miraflores porque quien asumiría la Presidencia de la República hasta el final del mandato, sería el Vice-Presidente Ejecutivo. Valga decir también que es de conocimiento público que las múltiples denuncias de fraude y violaciones constitucionales cometidas, motivó a la ciudadanía a organizarse en Comité de Victimas del Fraude, lo cual activó los mecanismos judiciales para defender sus derechos.

Con respecto a la supuesta suspensión por el Consejo Nacional Electoral, de los procesos electorales para Gobernadores, Diputados regionales; Alcaldes y Concejales, la verdad es que antes de cualquier evento electoral, los partidos de la derecha, articulados en la coalición MUD, así como los partidos de la izquierda aliados en el Gran Polo Patriótico, tienen una situación legal que deben atender según la ley de Partidos Políticos, Reuniones Públicas y Manifestaciones, que data del año 1965. 

De acuerdo a la misma, los partidos que no hayan sacado el 1% de los votos, en dos procesos electorales, de carácter nacional, deben acudir a un proceso de renovación de la militancia, con el 0,5% de la votación electoral en al menos 12 Estados. Es la situación de los partidos del Gran Polo Patriótico.

La situación de los partidos de la derecha aglutinada en la Mesa de la Unidad Democrática MUD, es que, según la misma Ley, los partidos políticos que no hayan usado sus tarjetas electorales, sus símbolos y emblemas en dos procesos electorales nacionales, quedan CANCELADOS, es decir eliminados. Es la situación de estos. Sin embargo, el Tribunal Supremo de Justicia, dictaminó que también podían acudir a renovarse para no quedar cancelados.

A despecho de la matriz lanzada a la comunidad internacional, mientras no se determine la situación legal de los partidos el Consejo Nacional Electoral no puede convocar las elecciones regionales según lo previsto. Solo el Partido Socialista Unido de Venezuela PSUV y otras tres agrupaciones totalmente nuevas, son las únicas que estarían calificadas para participar en los comicios electorales.

Lamentablemente, la intolerante oposición, hambrienta de poder, no ha sido capaz de entender su papel y tampoco sus responsabilidades como parte importante del Poder Público Nacional.

Señor Presidente del Consejo,

Respetados Representantes Permanentes,

El Diálogo ha sido y es la única opción que se ha privilegiado en nuestra patria en tiempos de Revolución democrática, goza del respaldo de la gran mayoría del pueblo venezolano y, además, tiene el acompañamiento del Papa Francisco, de la UNASUR y de los expresidentes Martin Torrijos de Panamá, del expresidente Leonel Fernández de República Dominicana y del expresidente José Luis Zapatero, de España.

Nuestro pueblo es defensor de su soberanía, ofrendó su vida por construir una patria común, y no dudaría en repetir la hazaña para su defensa de ser necesario, por lo que solo concibe y acepta las relaciones en la comunidad internacional, fundamentadas en el respeto más irrestricto a los principios del derecho internacional, entre los cuales prevalece, la autodeterminación y la soberanía popular.

La historia de los pueblos es una carta de presentación que habla por sí misma y aunque algunos traten de distorsionarla, esconderla, empañarla, esta permanece en la memoria histórica por generaciones y se expresa de manera inobjetable en el cuerpo social.

En ese orden, la Organización de Estados Americanos tiene pruebas palpables de la profunda convicción democrática, de paz y de diálogo. Venezuela ha demostrado que valora profundamente la paz y ha hecho grandes esfuerzos por preservarla para toda la región. Presente está, en múltiples formas, la huella generosa del respaldo que en todas las circunstancias entregó, por ejemplo, el Comandante Hugo Chávez y nuestro actual Presidente Constitucional Nicolás Maduro Moros, para el diálogo y las negociaciones de paz en Colombia.

No podría ser distinto lo que desea y ha garantizado nuestro pueblo para sí.

Preocupa entonces, la nueva fase del plan injerencista trazado por quienes pretenden torcer la voluntad del pueblo venezolano.

RECHAZAMOS, condenamos, que Luis Almagro, ficha obsesiva, obsecuente y visceral de Washington, núcleo del poder estadounidense, siguiendo sus instrucciones públicas y notorias, pretenda invocar contra nuestra patria la Carta Democrática Interamericana.

Es de Perogrullo pero debemos decirlo. Luis Almagro, NO nos representa. No le reconocemos facultad alguna de hablar o actuar en nombre del pueblo venezolano. Aún más, la conducta que ha expuesto abiertamente, nos permite inferir que no está, o no tiene incluso, condiciones morales, emocionales e intelectuales para representarse a sí mismo y sorprende que la OEA gaste los recursos financieros que no tiene, para dar beligerancia a quien pretende subrogarse las facultades que son propias de los Estados Miembros.

Los pueblos del continente observamos sorprendidos e indignados, tal obscenidad.

Tenemos muy presente, de la misma manera, que la Asamblea General de la OEA en República Dominicana, instruyó a ese órgano permanente a dirimir sobre la deplorable conducta de Luis Almagro y su inobservancia de la Carta de la OEA. Una tarea pendiente.

Quienes suscribimos esta comunicación, no dudamos en cumplir nuestras tareas. Nos corresponde defender ardorosamente nuestra patria con la verdad objetiva, nuestros alegatos, nuestro testimonio, con profunda convicción democrática. NO ACEPTAREMOS pasivamente las componendas conspirativas e injerencistas de quien hace ya mucho tiempo, debería estar fuera del cargo que indignamente ejerce como Secretario General.

Señor Presidente,

Representantes permanentes,

Condenamos, rechazamos y objetamos que la OEA retrograde, como lo pretende Almagro, a reconvertirse en el peón que fue en el pasado reciente.

No es un secreto que el pasado Gobierno de Estados Unidos, tutelado por los poderosos lobby de las corporaciones transnacionales, impuso un grueso entramado de desestabilización contra el modelo político bolivariano, con la activación del Decreto Ejecutivo de Barack Obama con el cual, sin argumento o prueba alguna, calificó a nuestro pueblo como “una amenaza inusual y extraordinaria” a su seguridad y a su política exterior.

Plan conspirativo que tiene vertiente militar según fue presentado por el General Jonh Kelly, el 12 de marzo de 2015, ante el Comité del Senado de Servicios Armados del Congreso de Estados Unidos y ratificado por el almirante Kurt Tidd, con una presentación el 16 de febrero de 2016, denominada Operación Venezuela Freedom-2.

Alertamos también a las delegaciones de los Estados Miembros que la nueva administración de Estados Unidos, enfrentada a serios obstáculos internos, sucumbió a las presiones, y decidió desconocer la oferta electoral que hizo a los jóvenes estadounidenses en edad de cumplir servicio militar y a los numerosos veteranos, que ha venido acumulando en su larga, ilegal e ilegítima carrera injerencista, lisiados física, emocional e intelectualmente, respecto a que no intentaría imponer a otros países su modelo político.

Hay intervención en puertas. Por eso Luis Almagro, consciente de su ilegalidad e ilegitimidad, ha exigido a las ONGs locales financiadas por la USAID y la NEG, las cuales no tuvieron el valor de repudiar el golpe de Estado, de abril de 2002 y no han condenado ninguna de las tropelías del fascismo, le demanden la expulsión de Venezuela de la OEA. Obviamente, es un burdo juego ampliamente conocido en la Organización, en la cual todos saben, quién es quién. No hay sorpresas.

Señor Presidente del Consejo,

Distinguidos Representantes Permanentes,

Nunca antes en la historia de la República Bolivariana de Venezuela el pueblo venezolano había estado tan claro en la defensa de sus derechos. Los ejercemos plenamente. Tenemos incidencia en las decisiones públicas, y de la misma manera, tenemos deberes y responsabilidades que cumplir. Estos son, entre otros, defender nuestra soberanía, al Presidente Constitucional de la República Bolivariana de Venezuela Nicolás Maduro Moros, que libremente elegimos, a nuestra democracia, al modelo político que nos hemos dado que, por cierto, es un imperativo en la Carta constitutiva de esa organización.

Los invitamos a no dejarse confundir. Les invitamos a continuar respaldado el Diálogo Nacional, porque los pueblos hermanos que ustedes representan en ese honorable Consejo Permanente, no se los perdonarían.

Your Excellency Ambassador PATRICK ANDREWS

Chairman of the Permanent Council of the Organization of American States.-

We, the undersigned of this communication, all democrat citizens, lovers of peace, social activists and convinced human rights defenders, respectfully hereby address to the Permanent Council of the Organization of American States that you chair to alert its members about the vicious intention attempting to talk them over that in Venezuela there is a rupture of the constitutional order, a humanitarian crisis, or any extreme situation that could mislead them to improperly apply the Inter-American Democratic Charter and create conditions to propitiate an armed intervention by the United States, a country that for long has been applying unilateral coercive measures, prohibited under the international law and under the Charter of this Organization.

Most of the Member States of the Organization, represented at this Council, have diplomatic representations in Venezuela, and therefore, they are fully aware that the pretension to sanction our country has no grounds. No deception is possible.

The Venezuelan people decided 18 years ago to undertake its own path from the perspective of participatory democracy - what we call the Bolivarian Revolution. In Venezuela, fundamental freedoms are fully exercised. We have a Government that earmarks the public resources to invest in the people and even more -and that is the reason why we elected it- that has put the people, and not the God Market, at the center of its public policies, so that it may become the protagonist of the economy.

In Venezuela we have the same problems endured by the other countries represented at the Council. The difference is that we possess enormous natural resources and we also had President Hugo Chavez, who raised the banners of socialism, sovereignty, Latin American and Caribbean union, and who vigorously heightened and practiced international solidarity, thus accomplishing the libertarian dreams of Bolivar, the Liberator.

Paradoxically, those who, from Venezuela, have been supporting interventionist ambitions against our homeland are also those who carried out a bloody coup in April 2002. Ever since, they have not changed their intolerant behavior. Instead, they have kept waging a wild Economic War against the people in Venezuela with the aid of their economic and commercial agents. In doing so, they have even managed to make huge profits for themselves. They try to lead the people to a dire situation. They are seeking an internal confrontation. They have failed to succeed because we have President Nicolás Maduro heading the Government. He has been able to face the economic war despite the declining oil prices as he adopted specific measures to ensure the people with access to food and medicines. Further, all social programs encompassed by the Missions and Great Missions which constitute the heart of the Revolution keep on working and achieving their goals.

The enemies of our Bolivarian democracy are the enemies of the National Dialogue process in Venezuela because they need to keep tensions alive as pretext to assault the legitimate power.

They persist in their obsessive pretension in spite of the fact that their coup of April 11, 2002 was fairly defeated. Even though President Hugo Chavez pardoned them, they have failed to recognize and continuously violate the will of the Venezuelan people to keep on supporting more strongly than ever before the political project that privileges the participatory and protagonistic democracy, the leading groundwork of the democratic social rule of law and justice provided under the Constitution of the Bolivarian Republic of Venezuela.

Their attitude has remained unchanged as they act in a suicidal, intolerant violent manner and disrespectful of the Bolivarian Constitution. Even when they have achieved what for many years they had not, that is, the chance to act as a democratic option from the National Assembly, they have failed to act democratically. On the contrary, their rage mounted. They failed to understand the message sent by the people.

The fact of the matter is that when they certainly gained sufficient electoral support to direct the National Assembly, the very day of their taking office, January 5th, 2016, they surprisingly presented a plan to oust the Constitutional President of the Bolivarian Republic of Venezuela, Nicolás Maduro, disregarding the fact that our Constitution does not grant any power whatsoever to the Legislative Branch of Government to act in such a manner against the Head of State.

They attempted to create confrontations between the Branches of Government, but our Constitution was drafted in order to maintain the stability of the State. The behavior of the antidemocratic opposition in Parliament is so erratic and inconsistent that, on the one hand they illegally decree that the President of the Republic has abandoned his office, and on the other hand they demand the Head of State to appear before the National Assembly to present his Annual Address to the Nation where he would file the annual report and accounts. This proves that they are not trustworthy.

Regrettably, the National Assembly is still held in contempt as a result of the decision of its current authorities, who have been repeatedly invited to return to the path of the Constitution.

It likewise becomes necessary to address two situations that the opposition has been manipulating.

In 2016, given the significant internal differences between the political groups making up the opposition, they failed to reach an agreement to activate a recall referendum in the proper time and in a time that were politically useful for them, that is, in the midterm, as provided for in the Constitution. Besides acting out of the proper time, they produced a significant number of signatures that were fraudulent and illegal taken from people under legal age and deceased individuals, which invalidated the long referendum process. However, the fact of the matter is that because of such reason any referendum and the hypothetical victory of the opposition would not take place before 2017. Their hypothetical victory would have not resulted in their seizing the Executive Branch of Government because had the president been recalled in that year, it would have been the Executive Vice President who would have taken office as President for the rest of the term. Likewise important is the widely known fact that the complaints about fraud and constitutional violations resulting from the collection of signatures led many citizens to create Committees of Victims of Electoral Fraud, thereby activating the judicial mechanisms to uphold their rights.

With respect to the alleged suspension of elections for governors, legislatures, mayors and councilors by the National Electoral Council, the truth is that before any electoral process, the right-wing parties making up the MUD coalition, as well as left-wing parties belonging to the Gran Polo Patriótico coalition, must comply with a legal requirement according to the 1965 Law Governing Political Parties, Public Assemblies and Demonstrations.

In accordance with the aforementioned Law, the parties failing to reach 1% of the ballots during two national elections are bound to go through a process to renew their militants’ lists with at least 0.5% of the voters register in, at least, 12 states. This is the situation of parties participating in the Gran Polo Patriótico coalition.

Likewise, under the same Law, those parties that have not used their electoral cards, signs and symbols during two national elections shall be deemed ANNULLED. This is the status of right-wing parties making up the MUD coalition. They are eliminated under that law. However, the Supreme Court of Justice ruled that they also can implement a process to renew their militants’ lists to avoid such annulment.

Despite the media campaign aimed at the international community, the National Electoral Council cannot call the regional elections as scheduled until the legal status of the parties is clarified. Only the United Socialist Party of Venezuela, PSUV, and other three totally new political groups would be legally in conformity to participate in elections.

Unfortunately, the power-hungry bigoted opposition has not been able either to understand its role or take on its responsibilities as an important Branch of Government.

Dialogue has been and is the only option privileged in our homeland in times of democratic Revolution. Dialogue is endorsed by the majority of people in Venezuela, is promoted by Pope Francis, UNASUR and former Presidents Martin Torrijos from Panama, Leonel Fernandez from Dominican Republic, and Jose Luis Zapatero from Spain.

Our people defends its sovereignty. Venezuelans gave their life to build a common homeland and are determined to repeat such feat if necessary. Therefore, our people only conceives and accepts relations in the international community based on the strictest abidance by the principles of international law, among which, self-determination and sovereignty outstand.

The history of the peoples speaks for itself, and even though some try to distort, conceal and tarnish such history, it remains in the memory of generations and is unquestionably manifested in society.

In this connection, the Organization of American States has tangible evidence of our deep democratic commitment to peace and dialogue. Venezuela has demonstrated that it values peace profoundly, and has also made important efforts to preserve it in the entire region. The generous mark left by the support given to the dialogue and peace negotiations in Colombia by Commander Hugo Chavez and our current Constitutional President Nicolás Maduro Moros is present in a myriad of forms and in all circumstances.

Our people cannot but wish and guarantee the same for itself. It raises concern, then, the new phase of the interventionist plan devised by those who intend to twist the will of the Venezuelan people.

WE REJECT and condemn that Luis Almagro, an obsessive, servile and visceral pawn of Washington -the heart of the North American power- following its public and notorious instructions intends to invoke the Inter-American Democratic Charter against our nation.

Platitudinous as it may seem, we need to state this: Luis Almagro DOES NOT represent us. We do not recognize any power he claims to speak or act on behalf of the Venezuelan people. In fact, the behavior he has openly displayed allows us to infer that he does not even have any moral, emotional or intellectual conditions to represent himself. Surprisingly, the OAS spends financial resources it does not have to make someone who intends to surrogate the powers of the Member States themselves belligerent.

The peoples of the continent surprisingly and indignantly observe such obscenity. We likewise keep in mind that the OAS General Assembly in the Dominican Republic commanded this permanent body to resolve on Luis Almagro’s deplorable behavior and his disrespect for the OAS Charter, an instruction which remains a task pending.

We, the undersigned, do not hesitate to comply with our duties. It is our task to fervently defend our nation with the unbiased truth, our arguments, our testimony and with our deep democratic convictions. WE SHALL NOT passively accept the conspiracies and interventionist fabrications of someone who should have been out of office long ago, an office which he still indignantly holds as Secretary General.

We condemn, reject and object that the OAS goes backwards, as Almagro intends, to become once again the pawn it used to be in the recent past.

It is not a secret that the former U.S Administration, led by powerful lobbyists of transnational corporations, imposed a complex framework of destabilization against the Bolivarian political model with the issuance of Barack Obama’s Executive Order whereby, with no argument or proof whatsoever, our people was deemed “an unusual and extraordinary threat” to the U.S. security and foreign policy.

It was a conspiracy with a military angle as shown by General John Kelly on March 12, 2015, before the Senate Armed Services Committee of the United States Congress, and ratified by Admiral Kurt Tidd on February 16, 2016, through a presentation called Venezuela Freedom-2 Operation.

We also alert the delegations of the Member States that the new United States administration, faced with serious domestic obstacles, succumbed to such pressures and decided to ignore an electoral promise made to young U.S. citizens and to many veterans -whose number has grown in its long, illegal and illegitimate interventionist history, and who are physically, emotionally or intellectually disabled. Such promise was that this new administration would not try to impose its political model on other countries.

There is an upcoming intervention. That is why Luis Almagro, aware of its illegality and illegitimacy, has urged USAID and NED funded local NGOs to demand the expulsion of Venezuela from the OAS. Such organizations did not have the courage to repudiate the April 2002 coup and are yet to condemn any of the outrages of fascism. Obviously, it is a coarse game widely known in the Organization where everybody knows who is who. There are no surprises.

Never before in the history of the Bolivarian Republic of Venezuela, have the people been so determined to defend its rights. We exercise them fully. We have a say in public decisions, and in the same way, we have duties and responsibilities to discharge, among others, the defense of our sovereignty, and the freely-elected Constitutional President of the Bolivarian Republic of Venezuela, Nicolás Maduro Moros; our democracy, our political model which, by the way, is an imperative in the Charter of this organization.

We invite you to not let them mislead you. We invite you to continue supporting the National Dialogue because doing otherwise would not be forgiven by the brotherly peoples you represent in that honorable Permanent Council.
